Service Terms and Conditions

This agreement, between the undersigned "Client" and Credit Mentoring & Consulting, Inc., "CMAC", with the principal business address of 70 Birch Alley Suite 240, Beavercreek, Ohio 45440, provides the terms of agreement and confirms enrollment in a CMAC service. 

Services to be rendered by CMAC for the Client include one or more of the following: 

(a) coaching, mentoring and guidance on improving a buyer's credit history, record or rating; 
(b) preparation of documents to assist with (a) herein; and/or 
(c) provision of educational materials to compliment (a) or (b) herein. 

The total cost for the “CMAC Express" service is $400. An initial, one-time setup fee of $200 is required for Client’s account setup, credit analysis, and educational initial consultation. A second, equal payment of $200 is to be automatically debited from the account on file after 30 days of services have been rendered. 

If Client has satisfied all suggestions and advice from his/her "CMAC Credit Expert" and he/she does not receive a 25 point minimum average increase on his/her FICO credit scores within 60 days of Enrollment Date, upon request and after review he/she will be refunded 100% of the monies paid to CMAC. Client understands that he/she must follow the advice or instruction of his/her CMAC Credit Expert or he/she nullifies his/her point guarantee. Client also understands that any new negative entries or adverse action upon his/her credit report(s) or score(s) after Enrollment Date will nullify his/her point guarantee.  

The Client authorizes CMAC to investigate and access the Client’s personal credit reports. CMAC is not liable for any results or responses received from credit reporting agencies or creditors. 

Agent Authorized to receive service of process:  Christina L. Hunt, 70 Birch Alley Suite 240, Beavercreek, OH 45440. With respect to the previous calendar year, CMAC performed 100% of its contractual obligations.

If you, the buyer, have been denied credit within the last sixty days, you may obtain a free copy of the consumer credit report from the consumer reporting agency. You also have the right to dispute inaccurate information in a report.

You may cancel this contract at any time before midnight of the third business day after the date you signed it. See the attached notice of cancellation form for an explanation of this right.

Credit Reporting Practices Rights of Consumers Under Ohio and Federal Law

Under the federal Fair Credit Reporting Act, you have all of the following legal rights:
You have a right to obtain a copy of your credit report from a consumer reporting agency. You may be charged a reasonable fee. However, there is no fee if you have been turned down within the preceding sixty days for credit, employment, insurance, or a rental dwelling because of information in your credit report. The consumer reporting agency must provide someone to help you interpret the information in your credit file.
You have a right to dispute inaccurate information by contacting the consumer reporting agency directly. However, neither you nor any credit services organization has the right to have accurate, current, and verifiable information removed from your consumer reporting agency report. The consumer reporting agency must remove accurate, negative information from your report only if it is more than seven years old. Bankruptcy information can be reported for ten years. Accurate information cannot be permanently removed from the files of a consumer reporting agency. Credit reporting agencies are required to follow reasonable procedures to ensure that creditors report information accurately. However, mistakes may occur.
You may, on your own, notify a consumer reporting agency in writing that you dispute the accuracy of information in your credit file. The consumer reporting agency then must reinvestigate and modify or remove inaccurate information. The consumer reporting agency must not charge any fee for this service. Any pertinent information and copies of all documents you have concerning an error should be given to the consumer reporting agency.
If reinvestigation does not resolve the dispute to your satisfaction, you may send a brief statement to the consumer reporting agency to keep in your file, explaining why you think the record is inaccurate. The consumer reporting agency must include your statement about disputed information in any reports it issues about you.
Under Ohio law, you have a right to sue a credit services organization that violates the Ohio Credit Services Organization Act. This law prohibits deceptive practices by credit services organizations and gives you a right to cancel your contract for any reason within three business days from the date you signed it.
No credit services organization shall conduct business in this state unless the organization has obtained a surety bond issued by a surety company authorized to do business in this state. Any person claiming against the bond for a violation of sections 4712.01 to 4712.14 of the Revised Code may maintain an action at law against the credit services organization and against the surety company. The aggregate liability of the surety company to all persons injured by a credit services organization’s violation of sections 4712.01 to 4712.14 of the Revised Code shall not exceed the amount of the bond.
The name and address of the surety company that issued the bond for Credit Mentoring and Consulting, Inc. (CMAC) is State Farm Fire and Casualty Company, 1440 Granville Rd., Newark, OH 43093.
Services to be rendered by CMAC for its clients include one or more of the following: (a) coaching, mentoring and guidance on improving a buyer's credit history, record or rating; (b) preparation of documents to assist with (a) herein; and/or (c) provision of educational materials to compliment (a) or (b) herein. The total cost for an individual is $400.
Also available to the buyer for assistance with credit and debt concerns are nonprofit credit counseling services. Please check your local phone book for listings.
The undersigned understands his/her rights, understands the services which will be provided, and acknowledges receipt of this statement.

Consumer Credit File Rights Under State and Federal Law

You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any ''credit repair'' company or credit repair organization has the right to have accurate,current, and verifiable information removed from your credit report. The credit bureau must remove accurate, negative information from your report only if it is over 7 years old. Bankruptcy information can be reported for 10 years.
You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days. The credit bureau must provide someone to help you interpret the information in your credit file. You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment in the next 60 days, if you are a recipient of public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.
You have a right to sue a credit repair organization that violates the Credit Repair Organization Act. This law prohibits deceptive practices by credit repair organizations. You have the right to cancel your contract with any credit repair organization for any reason within 3 business days from the date you signed it.
